Assuming original poster from India, definition of Full Time Employment is 48 hours of work per week in private sector and 44 hours of work in most public sector. Many people make mistake on this ( Completely forgetting how they slogged...:)). 5 years back one of my friend got an RFE on this... Lawyer, through his internal sources came to know that INS had problem with the note regarding 40 hours of week as they knew in India, generally Public sector remained open for 44 hours. My friend was public sector employee in India.

Consult a good lawyer without any further delay. If you are out of status then it's problem for GC also.

This is a really complicated case. You should consult a good attorney. The people in this forum are not lawyers. They just have some knowledge about immigration process and laws.

If I was in your place I will file for another H1B through Company B. There is a risk in this also as your current H1B extension is denied.

Stay in good terms with your current employer. Tell him once he is able to resolve the issue of H1B denial, you will come back to him. Also tell him once you get your EAD you will come back.

The problem is USCIS denied H1B extension due to non-compliance of rule in paying the employees, they can probably deny the 485 for the same reason.

Go ahead and apply for a birth certificate from your nearest US Embassy/Consulate.

You will need one anyway when you do file I 485 or CP so might as well keep it ready now.

I just received a confirmation email that I485 of my wife got approved just a couple of days back. But I myself have not received anything. Its kind of weird because she was my dependent and I was the primary applicant.

Can somebody please suggest if they have seen something like this before ?Do I need to do anything ?

Don't worry. I have seen several similar cases before. Most probably, you will get your case approved in a couple of days. Congrats for getting the GC.

Does the core team who have their boots in Washington have any knowledge of the date when the CIR will be introduced by Mr Kennedy . Days have turned to weeks then to months and we have been just hearing stories of the bill getting introduced "Next Week ".The press is spilling gallons of ink and the onliners are creating Gigabytes of forum data on Immigration Legislation and its outcomes, but nothing seems to come out of Capitol Hill , they are just going around in circles .Are they actually going to do something this year or is it just another eyewash ?

Prediction became a timepass... take my guess.. EB2 may move back to 98 (from the experiences of last two months) !! just kidding....

Nothing to be frustrated as i think everyone got used it by this time !! Keep cool...

Is there really that many applicants from India than China
The problem is even CIS layed off many people since 2004 and now are left with few people to work on. The left out people are not "like Indians in USA" kind of people.

And further more they cannot offshore processing to India as well. So what do they do......hmm lets retrogress Indians. Its working for them.

Did you get second finger print notice before approval? When did you go for first fingerprint notice?

I did not get a second finger printing notice (yet?). The 485 approval notice said that a biometric appt may be sent or the card will arrive. Just keeping my fingers crossed.

I-140 related to Company's potential to pay his salary not sachisdis qualifications; if he clear Perm EB2 ride then he is all set. Please clarify your concern…

no...education also checked during I-140. Just google 3 years degree and I-140 issues. Most of the time the PERM is gettting approval and only during the I-140 process people are facing issues.

Its better than not going to work and sitting at home playing with your kids or watching movies or shopping at walmart or doing laundry etc etc mulling about your future if you have time to spare for a thought
Who said the demonstrations have to be on weekday. You can very well do it on weekends and you can do it during your lunch breaks . What we lack is resolve not resources

You'd have to wait for PD to become current to add spouse.

Furthermore, if you get married before I-485 is approved, spouse may be added once PD becomes current, even though by then you have your GC.

Because they are sitting and looking at the Service Requests generated by the National Customer Service. There were 9000 of them a couple of days ago.

there have been rumors of EB2 India moving out of U.
Any notes with VB may be more important than the actual movement. So whether it is worth depends on the PDs.

I interfiled (ROW) in December, I'm not sure if they applied it.
When I spoke with an IO they seemed clueless about interfiling, thinking that new I485 had to be filed -- plain wrong. So be prepared to check up on them a month after filing. They should be able to tell you if the I140 is assigned to a I485. For me it is academic now because as of March I'll be within PD for EB3 or EB2.

I personally think we should try to encourage new people to open new threads, and not discourage them. This way, they also get a feeling like they own ImmigrationVoice and they are the part of it.

Well, I don't see a problem with that. If you can file 485 without clearing 140, why can't you file 485 without clearing labor?

We should stay modest? There are a lot of us who have waited 4+ years for labor. I think that's enough modesty and patience.


I think this is still in USICS control to allow I485 to file even if priority date is not current.
