I am in a similar boat [not sure about the reason though, no reasons were given]. My lawyer is going to re-file with premium processing citing an old receipt date of June 27th, 2007. Any updates from your side?

My i-140 premium processing application was filed on the 22nd of June,2007 as indicated in the information below. The package & check were returned in the first week of July. A letter indicating the reason for remittance and return was that the labor cert. attached was a photocopy and not the original.
Now what does not make sense here is that the original labor was sent along with the original i140 application filed last year(in june 2006).
I called the USCIS info line and the rep. suggested that i could resend it with an explanation.
What concerns me is if i do resend it, would it be considered only after suspension of i140 premium is lifted or would it be considered as a case from last month and processed under premium.

I'm a new member, so not sure whether this is the right place to post this. I've filed my I-485 @ NSC on July 5th and have not received a receipt yet. It's been more than 90 days.

Is anyone else who filed around that date still waiting to receive a receipt? Or am the only one?

It's fairly likely, since the judges will have made their selections before the weekend. I guess it depends on what Kirupa has planned for the weekend. :sure:

Question for July I-485 filers.
Did anybody receive I-485 July Rejection Notice by mail?

Mine is Opposite. EAD issued for 2 years even though my PD is current (based on interfile). Don't know whether the interfile is successful or not.

Should we lobby Cornyn to break this into two amendments.. one for unused visas.. and other for increasing the number of H1's. I think we have lost out on many occasions because of H1 increase request. I am sure proponents of H1 increase by this time will understand this request.

given CIR's debacle, anything increasing visa quota is a dead end. Nobody will touch it. I'm not saying it is a good idea, but it will guarantee a failure.

I suggest sticking to 'technical correction', stuff nobody cares about. Recapturing unused visas can be sold as just doing what congress mandated but bureaucrats were unable to pull off. The US public has no problem bitching about incompetent government agencies.

It is a different thing to convince everyone to let in even more immigrants that there already are.

Forget the H1-B quota increase, nobody will touch it.
Technical corrects may still be possible. Keep the debate as technical as you can. No emotions erupt from technical debates. People will react like 'who cares - I don't understand what you are talking about'

Is it advisable to put in a big % of your income into the retirement account. There seems to be a nearly 30% early withdrawal loss if you ever were to pull money early out of that prior to 60 years of age. So basically your own money will be lost.
Any ideas on this issue? It is not that I am planning to withdraw early but just for information purpose.

I have the exact question with duttasurajit -- my title for green card is computer information system manager, and I'd like to take a job for technical lead / architect. The job duties are very similar. Will that cause a problem?

btw: I don't know why so many people apply under the title of 'computer information system manager'. If you search Dice.com, hardly any position come out with this title.

I was under the impression that the job title does not matter for AC21 as long as the job duties are similar. For example, instead of IT Manager, say, I get a title of Developement Lead/Team Lead and the Job duties are similar.
What happens in this case? Is it still risky to pursue AC21?

Regardless EAD and AP are not affected by Priority Date. (Neither is I485 processing - I believe that as long as the PD is current, it is treated on an Receipt date of I485 - another benefit of filing I485 asap)

On Page 3 they say total Employement based preferences number was 162,176

Than on page 6 they say total Employement based preferences number was 147,148

147,148 is the limit for EB category where as 162,176 are actual issued visa numbers for fiscal year 2007

stop the guessing game. give some concrete info if you know it or let someone else that knows answer.

I do not believe they really have time to sort out by priority date if sep'30 is the date they need to get 40K approvals through.

My application was filed on 19th July .However I have not received my receipts yet. Has your friend contacted the USCIS and inquired since 90 days are over?

If you "extension of status" is denied, you can "re-enter" only with a new visa stamping on your passport. Same applies for family.

USCIS most probably will issue RFEs if the exact dates of out of status is not clear. And eventually if it become obvious of 4 months of out of status, I think mostly your extension of status will be denied. Only exceptional situations / explanations can get an extension of status / change of status approved even with 4 months of out of status.

At this point, I suggest you plan for the return to home country (even if it is temporary), and if you can secure an offer, file for H1 and wait for its approval in your home country. I know it is painful, but please do plan for it, to make it less painful.

Staying out of status too long will even affect your next entry. And I think 4 months is long. But it is your choice.

After I joined �B� company, I never went out of USA. �B� Company�s name is not reflected in my H1B visa (in passport). Only I have the copy of I129 with �B� company�s name. Now, I am no more with �B� company.

1. What is the process of re-enter to USA ? I mean, what type of documents I need to show to Immigration Dept ?

3. My families also need to re-enter to USA at the same time ?

Hopefully, I am able to explain my occurred situation correctly.

My PD is current. Still I am not discontinuing my 50.00 per month contribution that I have been doing since january.

As core team migth be knowing the solution, Can you please provide us some information whether we should go ahead and file today.
I don't think, anyone other than the USCIS/DOS will know the solution or whatever, at this time, untill the information is published to public. Applying AOS or not should be decided by you and your attorney. Not the core, Guess if the core has the updates that you are looking they might have updated in the home page :) by now...

Well I'm also waiitng to see what would be the updates from USCIS, as my 485 papers are not yet submitted but ready to go and the attorney would make the decision based on how this truns out to be... WSJ article is the one that is updates in various website/blog. Have to wait and see...

Hiring Manager has asked me to send him a link to the website which says I can start working once the application is submitted to USCIS....so that he can talk to his HR & other folks....
