I was wondering how many of you are here who had applied their labor with MS + 0 years of experience for EB2 category..

Could you please shed some light on your profile and current standing in GC process ??

My current position was advertised as MS with 0 years experience even though I had MS + 4 years experience. However I applied in old labor system (pre-PERM).

In last 2 months we collectively raised our voice on 3 occasions
1. CIR 07 debate in senate (Can you believe that for last 3 months of the fiscal year DOS moved EB3 India from Jun 03 to current?)
2. Flower campaign
3. San Jose rally
and we were rewarded.

Hi

I have a H1B visa valid till Apr 2009(still i can extend 3 more years). I am going to file I-140 and I-485 together on EB2 category. Along with this I am going to apply EAD for me and my wife.

What will be the status of my H1B if my EAD got approved and I-140 is still pending. In case if my I-140 get rejects, will i be out of status or I can continue with same H1B if i don't change company?

Or better to apply EAD for me (not to my wife) after the I-140 approval?

Please help me..

I have recevied I-140 RFE on all of the above u mentioned 1,2,3. i have 3 years degree.Labour doesnt match with edu.i am hpoing to get reject :).thats what attorney saying.

If you are serious..then be careful and prepare yourself to transfer H1b and start GC fresh.

The officer retains one of the original AP the first time. The other one that is handed over to you is stamped. So next time, you show the one that is stamped to enter and you will not have to give them any more copies.

I can't really answer your question without more details, but here are some factors to consider:

1. You can adjust status using a section of the Immigration and Nationality Act (INA) called 245k if you did not violate status for more than 180 days between your last lawful entry to the US and filing the 485. If you were in lawful status when the 485 was filed, or hadn't violated it for over 180 days, you may be OK.

2. You cannot stay in status by "piggybacking" one filing on another pending filing. Therefore, if your H-1B status #1 expired, #2 was pending and meanwhile your employer filed H-1B #3, the #3 does not keep you in status.

I am also one of those, who received the EAD while the online case status reads as "Case Received and Pending"

All the people that got the EAD approval have their pending I485 in the same service center where they applied for EAD renewal...does this have anything to do with their fast approvals?

I applied for EAD renewal at TSC on June 24 with a pending EB3 I485 pending at NSC. I still have not got an approval for EAD renewal!

Is anyone else in the same boat got their EAD approved?
Did I send my application to the wrong service center, I live in North Carolina?

I know several other people that got their EAD renewal application approved at TSC and these people applied about a month later than me!!!

this is going to be very subjective. even though there is detail less black in the first one in the nect area i think it "looks" fine. in my opinion there is too much detail less black in the second one, that makes it "look" too dark. also the first one is sooo good there's not much you can do with the second one to bring it to that level. thx, kevin

If the visa is already expired, you better wait to get the travel documents (AP) so you don't need to go for stamping.

If you use AP to go and return without stamping new H1, can you continue working with H1 or you've to use EAD? And if you use EAD, can you be with current employer?? This is confusing!! :confused:

My question is; Why do you really want to bring your jwellery here? Why not keep in some safety locker (bank) in India. Is it attractive to walk around with huge gold chains/bangles in the US? Also we have been hearing about burglaries in Indian households becuause of easy access to gold.
Buy gold and keep it in locker in India. Come here with some "duplicate gold" and live free.:D:D:D

Thats what we did when comming back to US in 2007 . but couldnot resist on few and bought along. Now those few are the one i am concerned about travelling back and forth!
Last time when i went to India took 10coins and had to feed the customs Rs.10K. Not sure if it was still a good math compared to pay cash and buy gold in India instead of travelling with coins.

Did you get second finger print notice before approval? When did you go for first fingerprint notice?

I did not get a second finger printing notice (yet?). The 485 approval notice said that a biometric appt may be sent or the card will arrive. Just keeping my fingers crossed.

My first FP was done in Dec 2007

what if your wife has a B1/B2 status.......can you still file for I-485?...Has anyone encountered a similar situations?

My mother-in-law applied for a B2 Visa and she was granted a 10 year/Multiple entry visa. At the POE, IO gave a 6months stay on her I-94 form. So far so good!

We wanted to extend her B2 for another two months so that we can go around a bit during Summer months. We applied for an extension ( I-539 Application to extend Non-immigration status) and we received an acknowledgement from VSC.

The question is, VSC is processing I-539 for August 07 and I dont think we would be getting her approval before her I-94 expires at the end of this month.

Some folks might have gone thru this situation before. Based on your experiences, can you pls. let me know what are the possible options here?

Right, the problem is: I do travel a lot and that makes a part time job difficult to find....

Other thing, the 6 months, is counted from the receipt date or the approval date?

Today based on the talks with my employer, he told that he will not be able to process my payments. I informed him that i am going to DOL. He has not committed but has said that legally he has to pay only the minimum wage requirement which is the 44000$ only. I am in the process to consult attorney at present.
